Kenya Implements New Gambling Regulations with Local Ownership Requirement

Kenya introduced updated gambling regulations on July 1 under the new Gambling Control Act. The legislation establishes a revised licensing framework and mandates local shareholding for all market participants.

Regulatory and Ownership Changes

The Gambling Regulatory Authority now oversees the sector, replacing the former Betting Control and Licensing Board. Every existing operator must submit a fresh application to maintain legal status under the new administrative structure. Foreign investors are required to allocate at least 30 percent of their company shares to Kenyan citizens, ending the previous allowance for fully foreign-owned entities.

Fiscal Adjustments

The tax framework has been modified alongside the licensing requirements. The deposit excise was reduced from 15 percent to 5 percent, and the 20 percent levy on net winnings was replaced by a 5 percent charge on withdrawals. Despite the lower statutory rates, overall tax collection increased by 29 percent following the implementation of the new rules.
